Attorney-on-duty: What is the “toban-bengoshi” system in Japan?
If you are arrested in Japan and need advice from a lawyer, you can specify a particular attorney or ask for the attorney on duty known as “toban-bengoshi”.
The police will call the local bar association to request the duty lawyer to visit the suspect being detained to advise on his rights, his current position and forthcoming procedure. This is conducted free of charge and proves to be of great help to many suspects arrested without notice.
There is however, a drawback to this system that may greatly influence the outcome of a suspect’s case. Not all lawyers on the duty roster are specialized let alone experienced in the criminal defense system and may not necessarily be able to give the best advice. Yes, of course they are fully qualified as attorneys, but just like you would want to look for a reputable doctor when getting a big surgery, it is advisable to look for a reputable criminal defense lawyer to deal with your criminal defense needs.
