The advantages of asking for an attorney on duty are obvious. You or your arrested family member will be able to receive prompt legal advice prior to prosecution and will be given the option of retaining that attorney to represent you for the rest of the case. Being given correct advice on how to deal with your police interview before prosecution is crucial in preventing any actions or statements you make becoming disadvantageous evidence in the forthcoming process.

On the other hand, due the attorney on duty being chosen from a pool of listed attorneys on a voluntary basis, it does not guarantee expertise of the attorney in the sort of crime/case you are involved in nor in criminal law itself. Every step in the criminal process has an attached deadline, and just a single day wasted may mean freedom or imprisonment to you.

To avoid this situation, it would be best to retain an attorney who you know to trust, or to appoint someone to find an attorney specializing in criminal law.
