FAQs
Q. What is a “non-prosecution”?
A. After you are arrested by the police for a crime, your case is handed over to the prosecutor who will decide whether to prosecute you i.e. proceed your case to trial or not.
If the prosecutor decides not to prosecute you, your case will be closed and you will not face further investigation or trial.
Q. What is a “suspended sentence”
A. After you are found guilty at trial, the judge has the discretion to grant you a suspended sentence. The idea, is that you will get a probation period of (usually) several years during which time you must not commit any other crimes and must abide by a set of rules fixed by the judge. If you make it through that time without breaking the law or the rules, your sentence is usually dismissed.
